Advertising Creative Guidelines and Policies

All creative elements are required to meet the preset Ad Specifications, listed here. In addition, all advertisements submitted to or provided to United Online Advertising Network (UOAN) for display on or through the UOAN network of websites (UOAN Sites), pursuant to a fully executed Insertion Order signed by the Advertiser and UOAN, must comply with the Advertising Creative Guidelines and Policies listed below.
These Guidelines are not an exhaustive list and are only intended to provide the Advertiser with examples of the application of UOAN requirements. UOAN reserves the right to review, request modifications to, or reject any advertisement, at any time, at its sole discretion.
I. Use of UOAN Corporate Logos and Titles. Advertiser agrees that it will not provide or submit to UOAN advertisements containing content, or otherwise use any content in advertisements or on the websites to which such advertisements link, that:
- Uses trademarks or the corporate logo of any UOAN Site in written format or graphics without first obtaining the appropriate co-brand and/or co-marketing license.
Example: Any creative unit featuring the Classmates logo without a co-brand license in place will not be accepted.
Example: Any use of the NetZero logo, NetZero navigation and NetZero messaging without a co-marketing agreement in place will not be accepted.
- Uses the copyrighted materials of, or otherwise mimics or is similar to the look and feel, content or functionality of, any UOAN Site.
Example: Content cannot mirror Classmates navigation, dashboard and/or any Classmates user navigation functionality.
- Uses the word "Classmates" in a generic sense, in creative and/or messaging.
Example: "Find your Classmates today" would not be accepted. "Find 'Old Friends' today" would be accepted.
Example: Other acceptable words could include: High School Friends, Former School Buddies, etc.
- Offers a special price or discount to UOAN Members (Free or Paid) without an existing legal contract agreement in place where the advertiser agrees to provide a special discount for UOAN Members - or - Does not have the appropriate license to use UOAN Site trademarks.
Example: "Special price for NetZero members" messaging would not be acceptable without a legal contract approving the special discount.
II. Advertisements may not mislead the user. Advertiser agrees that it will not provide or submit to UOAN advertisements containing content, or otherwise use any content in advertisements or on the websites to which such advertisements link, that:
- Contain false/imitation Windows interactivity.
Example: False buttons, expand/minimize/close buttons, downloading messages, pull down menus, or error messages
Example: Mimic or resemble Windows/Mac/Unix dialogue boxes.
- Promotes a false free offer, free gift, or special sale. Advertiser messaging including the word(s) "free" must indicate that the consumer is paying nothing for the product or service being promoted (click here for more details).
- Promotes false dietary claims, misleading consumers as noted by the Federal Trade Commission (FTC) (click here for more details).
- Could be deemed to constitute bait and switch advertising pursuant to FTC guidelines (click here for more details).
- According to FTC guidelines and policies, could be considered deceptive (click here for more details), unfair (click here for more details), or containing deceptive pricing (click here for more details).
III. Prohibited Content. Advertiser agrees that it will not provide or submit to UOAN advertisements containing content, or otherwise use any content in advertisements or on the websites to which such advertisements link, that:
Promotes discrimination, violence or displays defamatory or libelous material.
Misrepresents, ridicules, or attacks an individual or group on the basis of age, color, national origin, race, religion, sex, sexual orientation or disability.
Promotes illegal activities.
Targets Children. Advertising directed to children aged under 13 is prohibited on any UOAN Site.
IV. Questionable Creative/Copy requiring UOAN approval. The following types of creative/copy are subject to the prior approval of UOAN, which approval may be withheld in UOAN's sole discretion:
- Flashing, shaking, rolling, pulsing (etc.) text or colors.
- Contains religious content.
- Adult-related advertisers or content.
Example: Promotes Viagra/Vigel.
Example: Sexual embraces or poses, sexual expressions/innuendo, bathing wear.
- Promotes online and offline casino gambling.
- Promotes alcoholic beverages.
- Promotes tobacco.
V. Advertiser Landing Page Requirements
- Advertisers must not display 3rd Party Pop-Style ads to users upon the first page view after clicking on an advertiser's offer on the NetZero/Juno/EOW start pages.
- One In-House/Internal Promotion Pop or Floating message allowed upon user landing at the page.
- ActiveX or automatic downloads are prohibited upon user arrival at an advertiser's website.
- All browser functions must be allowed to work properly and as intended by the manufacturer.
Example: Browser Back Button must be allowed to work as intended.
- No advertisements on the landing page that promote any product or service which is reasonably competitive with any of the products or services offered by any entity directly or indirectly controlling, controlled by, or under direct or indirect common control with UOAN.
